Owner agreement sample
Read the agreement before applying. Review the letting arrangement, costs and responsibilities before deciding to work with LIVIA.
This is the standard sample for an ordinary building lease with an 85/15 collected-rent allocation. It is not an executed agreement. Names, property details, dates and other individual terms remain blank. They are confirmed with the required explanation and both parties’ signatures before contracting. Viewing or downloading does not submit an application, enter into an agreement, or incur a charge.

Start with these six points
These reading points do not replace the full terms below.
85% owner · 15% LIVIA
Use collected sublease rent (including rent for additional occupants) after corresponding rent refunds. The 15% is monthly operations; agreed expenses are separate. No fixed or minimum rent is guaranteed.
Month-end close · payment by the next 20th
Calculate monthly for paid stays that have started and elapsed. Future prepaid days are not paid out at once. A Japanese bank holiday brings payment forward to the preceding banking day.
Reserve your own available dates
Hold available dates in your portal and confirm costs and access. Existing resident agreements, bookings and preparation days remain protected; immediate unconditional recovery is not promised.
Owner furniture · LIVIA Wi-Fi
Reuse suitable furniture and appliances. Purchase and age-related repairs are normally owner costs. LIVIA arranges Wi-Fi, with special installation and costs agreed separately.
Agree expenses before deduction
Furniture funding follows your selected plan. Building repairs, fire insurance, special cleaning and agreed owner costs remain separate. LIVIA arranges Wi-Fi; special installation and costs require prior agreement. No unagreed deductions or double-charging of LIVIA-funded furniture purchases. The owner contracts and pays for building fire insurance suitable for subletting under the agreement.
Ordinary lease renewal and lawful ending
Renew under the agreement after its initial term. Changes, termination and existing residents follow the agreement and Japanese law. Reading this sample does not start the lease.
Full agreement sample · English translation
The full English translation comes first, followed by the same edition in Japanese. Ask LIVIA about any unclear or inconsistent wording before signing. The effect of each language is agreed in the individual contract.

Articles 2 and 3 — Revenue-Linked Rent, Expenses and Monthly Settlement
The rent payable by Party B to Party A shall be 85% of the sublease rent actually received from occupants less amounts actually refunded in respect of that rent (hereinafter "Net Sublease Rent Received"), and Party B's allocation shall be 15%. The allocation rates for contracts already concluded shall remain as recorded unless both parties agree to a change. There is no guarantee of fixed rent or minimum rent. Where no rent has been received for a period of vacancy or non-payment, no revenue-linked rent shall accrue for that portion.
Party B's allocation consists of a monthly-stay operating fee of 15% of the Net Sublease Rent Received, taken as 100%, for a total of 15%. Party B's allocation shall be treated entirely as the monthly-stay operating fee and shall not be divided into card payment fees, advertising costs or contract fees. These are categories of the agreed rent differential included in Party B's allocation, and shall not be deducted additionally or twice from Party A's allocation. They do not constitute a guarantee of the actual processing fees paid to payment service providers, actual advertising expenditure, or profit after deduction of expenses.
Any change to the individual allocation rates shall be agreed between Party A and Party B in writing or by electronic record, including the details of the change and its effective date. Party B's allocation shall be classified as the monthly-stay operating fee. A change to system settings alone shall not retroactively change existing agreed terms or statements already issued.
When calculating amounts, Net Sublease Rent Received multiplied by Party A's allocation rate shall be calculated with any fraction of JPY 1 discarded, and the remainder shall be Party B's allocation. Party B's entire allocation shall be the monthly-stay operating fee and shall not be deducted again from Party A's allocation.
The monthly attribution period, prorating and rounding based on cumulative differences shall follow the payment terms in Appendix 2. Where those payment terms provide for monthly allocation based on elapsed days, receipt of advance payments alone shall not be treated as making payment for future days of the stay due.
Only rent is subject to allocation. The occupant's system usage fee of 5%, management fee of 10%, contract administration fee of JPY 10,000, cleaning fees, flat-rate utilities and Wi-Fi usage fees, security deposits and other funds held on deposit are excluded. Uncollected amounts shall be settled when received. Refunds, cancellations, discounts and corrections for prior periods shall be settled with the relevant period and grounds identified. The occupant's flat-rate usage fees shall not be reconciled against actual costs upon move-out.
Repairs, owner-use charges and other expenses payable by Party A, and contributions to reserves, shall be limited to those for which the responsible party, subject matter, amount or calculation method have been agreed in advance. Party B shall separately show rent received, rent refunded, allocations, each deduction and the net amount payable in the income and expenditure statement, and shall deduct agreed amounts from the rent payable to Party A in accordance with that agreement.
Appendix 2 — Payment Terms: Of the paid Net Sublease Rent Received, the portion corresponding to days of a stay that has actually commenced and elapsed shall be closed at the end of each month. Advance payments for days of the stay that have not yet occurred shall not be included in the amount payable for that month. An income and expenditure statement shall be provided by the 20th of the following month, and payment shall be made by bank transfer to the account in the lessor's own name designated by the lessor by that same day. If that day is a bank holiday, the deadline shall be the immediately preceding business day. LIVIA shall bear the transfer fee. During the contracting process, the lessor shall register a yen-denominated bank account in the lessor's own name at a bank in Japan through the Owner My Page, and both parties shall verify the bank, branch, account number and account holder's name. LIVIA shall verify the registered details before the first payment and verify them again upon any account change. Account information shall be stored in encrypted form. The verified registered account shall be included in the transfer documentation for the responsible staff member, who shall carry out the procedure through the bank. Account information shall not be included in ordinary email or on public pages. Receipt into an overseas account shall be discussed separately. The individual allocation rates for the lessor and LIVIA stated in the Contract Particulars and the monthly-stay operating fee stated in the main text shall apply. No fixed amount, minimum amount or occupancy rate is guaranteed. Rent received and rent refunded in the current month shall be shown separately, and corrections for prior periods shall identify the relevant month and grounds. The cumulative eligible rent for each reservation shall be calculated by multiplying the paid rent eligible for allocation by the number of elapsed nights, dividing by the total number of nights, and discarding any fraction of JPY 1. The cumulative lessor allocation shall be calculated by multiplying this cumulative eligible rent by the agreed lessor allocation rate applicable to that reservation and discarding any fraction of JPY 1. The current month's eligible rent and lessor allocation shall each be the difference between the cumulative amount through the end of the current month and the cumulative amount already recorded through the end of the previous month. The allocation rate shall not be applied again to the monthly amount with a further rounding down. If payment is received late, elapsed amounts not yet recorded shall be reflected in the month of receipt. Where the basis of calculation requires verification because of a refund, early move-out, schedule change or similar event, the details shall be verified before the statement is finalized. Rent qualifying as a lease for residential use shall be treated as non-taxable, and the tax classification of separate services and other transactions shall be shown in the statement according to the actual transaction and applicable law.
Articles 4 and 5 — Property Preparation, Marketing and Maintenance
Party A provides a dwelling that Party A is authorized to lease. Furniture and appliances are prepared under the selected furniture plan and individual terms in this agreement. Party A discloses authority documents, building rules, safety restrictions and known defects to Party B. Party B prepares and registers property information, photographs and marketing materials. Account registration alone does not constitute consent to subletting or conclusion of a contract.
Furniture plan: supplied by the lessor (85% lessor / 15% LIVIA). The lessor bears the preparation and purchase costs of the furniture agreed by both parties in the inventory, reusing suitable existing furniture. Furniture purchased by the lessor belongs to the lessor. If LIVIA arranges procurement or advances payment, the parties agree the items, specifications, amounts, cost allocation and payment or deduction method beforehand. Unagreed costs are not deducted unilaterally.
If Party A asks Party B to procure furniture outside the LIVIA-funded scope of this agreement on Party A's behalf, the parties shall agree in advance to a quotation specifying the items, actual delivery and installation costs, arrangement fee, delivery schedule, ownership, warranties and responsibility for replacement. No arrangement fee rate or minimum fee shall apply automatically, and no charge shall duplicate ordinary operating services.
Party B shall handle occupant support, move-in and move-out guidance, arrangements for cleaning, key changes, inspections and similar work, payment reconciliation, income and expenditure reporting, and refund management. The specific items, frequency, service providers, cost allocation and method of reporting to Party A for maintenance and inspections shall be set out in the attached maintenance schedule.
Party B shall outsource cleaning, key-related work, repairs and inspections to partners to the extent necessary and shall verify each contractor's scope of work and required qualifications. Key information, photographs and occupant information shall be shared only to the extent necessary for the assigned work. Such outsourcing shall not automatically confer authority to conclude contracts or conduct solicitation on behalf of Party A or Party B.
Appendix 3 — Furniture, Equipment, Maintenance and Insurance: Furniture and equipment list: [To be completed individually: furniture, appliances and equipment provided, and known defects] Furniture plan: supplied by the lessor (85% lessor / 15% LIVIA). LIVIA shall arrange Wi-Fi equipment and connectivity. Where use of an existing line, construction work or special costs are involved, the details and cost allocation shall be confirmed separately. At each move-out, LIVIA shall inspect the condition of the interior, bathroom, kitchen, furniture, equipment and keys, and arrange cleaning, key changes and necessary repairs with the responsible partners. LIVIA shall not conduct routine patrols inside occupied units or enter without authorization, and shall respond based on occupant reports and lawful entry procedures. The lessor shall arrange and bear the costs of statutory inspections and major repairs of common areas and the building itself, fixed asset tax, management fees payable by the owner and similar costs. Common areas shall be subject to the building manager's management rules. Ordinary operating administration, marketing and occupant support are included in LIVIA's allocation. Repairs and replacement of owner-owned equipment due to aging and similar causes shall be borne by the lessor. LIVIA shall address damage attributable to LIVIA or its contractors in accordance with applicable law and the cause. For repairs not yet agreed upon, costs shall not be deducted unilaterally; photographs, a quotation and the proposed responsible party shall be presented for agreement. Work performed shall be recorded in My Page upon completion and reported together with the monthly statement. Party responsible for obtaining insurance and scope of insurance: The lessor shall directly contract for fire insurance for the building at the property that covers its use for residential subletting (monthly rentals), bear the premiums, and maintain coverage throughout the contract term. If an existing policy is used, the lessor shall also confirm with the insurer that the coverage accommodates subletting. The lessor shall confirm with the insurer the scope and conditions of any coverage needed for furniture, appliances and other property owned by the lessor. Insurance may also be arranged after conclusion of the contract. However, the lessor shall report the insurance status, coverage period and scope of coverage to LIVIA and acknowledge that there is no insurance coverage during any period when insurance is not in place, has lapsed, or does not cover the property's use. No guarantee is made that insurance is currently in place or that coverage applies. The actual insurance policy shall determine the scope and conditions of coverage. Regardless of whether insurance is in place, responsibility and cost allocation for accidents and similar events shall follow applicable law, this Agreement and the cause, and liability arising from intent, negligence or similar fault of LIVIA or its contractors shall not be transferred indiscriminately to the lessor. Listing photographs shall be used only for marketing the property and operational communications. Personal information and key codes shall not be made public.
Articles 6 and 7 — Owner's Personal Use and Repairs
For Party A's personal use, Party A shall request the desired period through My Page or a similar channel, and both parties shall confirm the dates after checking existing reservations and operating schedules. A request alone shall not be treated as securing the dates, and existing agreements with occupants shall not be cancelled unilaterally.
The processes for entry guidance, key handover, move-out reporting with photographs, key return, cleaning and condition inspection shall also apply to personal use. Entry shall be no earlier than 08:00 on the confirmed move-in date and shall follow the notice that preparation is complete. Move-out shall be completed by 20:00 Japan time on the confirmed move-out date. After actual surrender of possession, return of the keys and other relevant facts have been verified, a partner shall change the keys and commence work no earlier than the day after the move-out report is confirmed. If photographs or electronic reporting are difficult, alternative verification by telephone, registered email or similar means shall be arranged. Incomplete reporting alone shall not determine that use is continuing, that surrender of possession has occurred without verification, or that additional costs are payable.
Cleaning fees, utility charges and other costs for personal use shall be itemized using amounts or calculation methods agreed before use is confirmed, and shall be deducted from the rent payable to Party A for that month or another applicable month in accordance with the agreement. Any amount exceeding the rent payable shall be shown as a shortfall and handled under the payment or carry-forward method agreed in advance. Amounts not agreed upon shall not be deducted automatically, and shortfalls shall not be waived automatically.
Ordinary repairs and additional work shall be approved after verification of photographs of the pre-work condition, the necessity of the work, the estimated amount and the responsible party. Emergency measures to prevent danger or worsening damage shall be limited to the minimum necessary within the scope permitted by law and prior agreement, and the details, costs and evidence shall be reported promptly. No blanket approval spending limit shall be established without agreement.
Appendix 4 — Personal Use and Emergency Response: Both parties shall confirm dates for the lessor's personal use that do not overlap existing reservations. Entry shall be no earlier than 08:00 on the move-in date, and move-out shall be completed by 20:00 on the move-out date (Japan time). Cleaning fees and flat-rate utilities and Wi-Fi usage fees shall be deducted from the rent payable to the lessor for the month in which use ends only in the amount to which the lessor agreed in the quotation presented in My Page before use. Flat-rate usage fees shall not be reconciled against actual costs upon move-out. Any shortfall exceeding the rent payable shall be paid by bank transfer by the end of the month following the month in which the statement is provided, or carried forward if both parties agree by a method that leaves a record. Emergency measures to prevent danger or worsening damage shall be limited to the minimum necessary with lawful entry, and the situation, photographs and costs shall be reported promptly to the registered contact details. Non-emergency additional work for a fee requires prior agreement.
Articles 8 to 10 — Rent Revisions, Term and Termination
Changes to rent or allocations shall be explained, including the reasons, basis, effective date and effect on expenses, and both parties' agreement shall be recorded in writing or electronically. Rights such as claims for rent increases or decreases under Article 32 of the Act on Land and Building Leases shall not be excluded indiscriminately where applicable. The applicable terms shall be expressly stated in an appendix in accordance with the type of agreement and applicable law, including where a special rent revision provision is included in a fixed-term building lease.
The term, renewal or recontracting, early termination, termination notice and penalties under this Agreement shall be as stated in the Contract Particulars and attached individual terms. Where Party A refuses renewal or gives notice to terminate an ordinary building lease, justifiable grounds and other statutory requirements must be satisfied. No provision shall state that notice alone automatically terminates the Agreement.
Termination for breach shall follow the nature of the breach, a demand to cure and the requirements of applicable law. If the property becomes unusable, a disaster occurs, the building is sold or attached, or a similar event occurs during the contract term, the parties shall promptly share the circumstances and effects, and discuss rent, repairs, notices, succession to the Agreement or its termination in accordance with applicable law.
At termination of this Agreement, the parties shall confirm in writing the handover of agreements with occupants, the lessor's position, security deposits and similar funds, receivables and payables, keys, equipment, photographs and documents, taking into account the cause of termination and applicable law. Occupants shall not be required to move out, and keys shall not be changed without authorization, solely because the master lease has ended.
Appendix 5 — Renewal, Cancellation and Termination: This Agreement is an ordinary building lease, with the period in the Contract Particulars constituting the initial contract term. Upon expiry, it shall renew automatically on the same terms for the same period and continue until lawfully terminated. This does not, however, prevent refusal of renewal or termination that meets the notice periods, justifiable grounds and other requirements of the Act on Land and Building Leases, termination by mutual agreement, termination for cause under applicable law or similar action. The lessor expressly consents to LIVIA entering into residential subleases with a final move-out date no later than 2 calendar years after the date, in Japan time, on which each application is accepted. The scope of this consent shall not be shortened solely because of the number of days remaining in the initial term of the master lease. After a lawful termination date for the master lease has been fixed, no new reservations extending beyond that date shall be accepted. Existing subtenants' rights shall be respected, and necessary notices, consents, succession to the sublessor's position or arrangements for surrender of possession shall be made. LIVIA may give notice of early termination in writing or electronically 3 months in advance. Existing agreements with occupants shall not, however, be terminated unilaterally, and handover arrangements shall be made. Any change to rent or allocations shall be explained with its reasons, basis and effective date, and the agreement shall be recorded. Where Article 32 of the Act on Land and Building Leases applies, the rights to claim increases or decreases under that Article shall not be excluded. The lessor shall not be treated as being obliged to accept unconditionally a request for a decrease that meets the prescribed requirements. For termination due to non-payment or a material breach, a demand to cure within a reasonable period and other necessary steps shall be taken in accordance with applicable law. No fixed penalty shall be imposed. Where damage occurs, the parties shall discuss it based on attribution of responsibility, actual loss and applicable law. Upon termination, as a general rule, the lessor shall succeed to the sublessor's position and the corresponding rights and obligations under subleases that lawfully remain in effect, and necessary notices, consents and other procedures shall be completed while respecting occupants' rights. A handover document shall be prepared for security deposits and other funds held on deposit, receivables and payables, keys, equipment and documents. Within 14 days after move-out, LIVIA shall arrange repayment of any undisputed occupant security deposits that it is required to return. The final statement shall be provided by the end of the month following the month of termination, with unresolved issues pending finalization and the undisputed balance settled separately.
Articles 11 to 13 — Explanation, Delivery of Documents and Confirmation of the Agreement
Before conclusion of the Agreement, Party B shall provide a document setting out the material matters applicable to a specified lease contract and explain them in a manner Party A can understand. Explanations for new contracts shall be given in person or by two-way video and audio after verifying the necessary environment. Sending documents or clicking checkboxes alone shall not substitute for giving the explanation. Sufficient opportunity to consider the terms and ask questions shall be provided.
The pre-contract explanatory document, records of the date, time, method and person responsible for the explanation and the questions and answers, prior consent to electronic delivery, documents provided at conclusion, and signature records shall be stored separately. Holding a registration or qualification, or the number of units managed, shall not by itself be treated as exempting a party from rules governing advertising, solicitation, explanation and other matters for specified lease contracts.
For electronic delivery, Party A's prior consent shall be obtained after identifying the documents covered, PDF format, methods of provision and storage, and viewing environment. If Party A does not consent, the method of delivery in paper form shall be explained. The party concerned or a duly authorized person shall sign the same finalized Agreement and appendices, and the signed PDF and certificate of completion shall be retained. An image of a seal impression is not itself an electronic signature.
Both parties shall handle non-public information learned in performing the Agreement only to the extent necessary and shall not disclose it to third parties except where required by law or necessary for performance. Changes to notification details shall be reported promptly. Damages, force majeure and dispute handling shall be governed by applicable law and individual agreements. No provision shall indiscriminately exempt a party from liability.
Appendix 6 — Explanation, Document Delivery, Retention and Other Matters: Before conclusion of the Agreement, LIVIA shall provide a material matters explanatory document for the specified lease contract and explain it in person or through a video call in which the other party can review the documents and ask questions using two-way video and audio. Documents, checkboxes or signatures alone shall not substitute for the explanation. However, if actual supporting documents establish that the other party falls within a category of professional business operator or other person specified by law, the exemption from the material matters explanation shall be recorded together with the category, supporting documents, person responsible for verification and version of the documents covered. This exemption does not dispense with the prior explanation in a separate document to be given by the lessor to LIVIA for a fixed-term building lease, consent to electronic delivery, delivery and review of the documents, or the party's own signature. For electronic delivery, the methods of viewing, saving and printing PDFs shall be explained and the other party's prior consent recorded. Requests for paper documents shall be accepted at info@livia.jp or 080-7003-0314. No ordinary document delivery fee shall be charged, and the delivery date and method shall be communicated individually. Business hours are weekdays from 11:00 to 17:00 Japan time. Required explanations shall actually be given outside the system. Records of the responsible person, date and time, method, document version, questions and answers and other relevant matters shall be appropriately retained. Screen operations in this system shall not automatically record that an explanation has been given. The master lease shall be activated after the signed original and certificate of completion have been saved. The party concerned or a person whose authority has been verified shall sign. Checks performed on behalf of the party by the operator shall not substitute for that party's consent or signature. As a general rule, records of agreements, explanations, consents, signatures and settlements shall be retained for 10 years after termination of the Agreement, subject to statutory retention periods and the needs of disputes and preservation. Access to unnecessary information shall be restricted. Work requiring registration or similar procedures shall be performed only within the scope for which the necessary procedures have been completed. This Agreement shall be governed by Japanese law. The Japanese court having jurisdiction over the location of the property shall be the agreed court of first instance for disputes concerning this Agreement, without prejudice to exclusive jurisdiction or other requirements under applicable law.
Article 14 (Confirmation of Property Provision and Cooperation): Party A shall provide Party B with accurate documents concerning Party A's authority to lease the property and consent to subletting, necessary consent from co-owners or other relevant parties, building management rules and use restrictions, material equipment defects, and the availability of the property throughout the contract term. Party A shall promptly notify Party B of any change to that authority or those conditions. If Party B suffers damage because Party A provided inaccurate information for which Party A is responsible, necessary action and settlement shall be carried out in accordance with the cause, attribution of responsibility and applicable law.
Article 15 (Personal Use and Performance of Tasks on Behalf of Party A): Party B may register the property, photographs and documents and carry out ordinary operational processing on Party A's behalf based on verified information provided by Party A. Processing on behalf of Party A shall not replace Party A's own consent and signature. Personal use shall follow Party B's guidance on dates that do not overlap existing agreements with occupants. Agreed cleaning fees and flat-rate utilities and Wi-Fi fees shall be shown separately in the income and expenditure statement. The items subject to set-off, grounds and amounts shall be shown, and settlement shall be made under this Agreement or a separate agreement. Costs not agreed upon shall not be deducted without authorization.
Article 16 (Communication with the Operator and Records): Party A shall not obstruct Party B's performance of its contractual obligations by independently charging occupants or contractors, changing keys during occupancy, entering without authorization or similar conduct, and shall coordinate necessary action with Party B. Party B shall distinguish income, refunds of eligible rent, allocations, owner-use charges, approved additional costs, planned remittances and actual transaction records, and make them available to Party A through My Page. Calculation or remittance errors shall be retained as a history of corrections or cancellations without deleting finalized original records.
The parties shall review the Contract Particulars, all articles and the attached individual terms set out in this document as an integrated whole, and conclude this Agreement after the necessary explanations and electronic delivery. Creation or viewing of documents alone shall not be recorded as conclusion of the Agreement.
